State Bureau, Ranchi. The Supreme Court has upheld the order to regularize the services of Moti Ram, who worked as a gardener in Deoghar at a daily wage of Rs 51.
The Supreme Court, exercising its prerogative under Article 136 of the Constitution, rejected the Marketing Board's SLP. The Supreme Court upheld the order of the High Court to regularize the applicant. The applicant has been providing regular service for 24 years.
Moti Ram, a resident of Bumpass Town, Deoghar, was appointed as a daily wage gardener in Deoghar Marketing Board in June 2001. He was hired to take care of 10 mango saplings planted near the administrative building. At that time his wages were fixed at Rs 51 per day.
In the year 2015, Moti Ram applied for increase in wages. In this he told that he gets only Rs 4346 monthly. After this, the then Deputy Commissioner ordered to increase his wages to Rs 7593 per month in March 2015.
In the year 2020, the district administration issued a notice regarding regularizing the services of daily wage workers working for 10 years or more. Under this, Moti Ram also applied, but when no decision was taken, he filed a petition in the Jharkhand High Court.
During the hearing in the High Court, it was argued on behalf of the Marketing Board and the administration that Moti Ram was a daily wage employee and there was no condition for regularizing the service. In February 2023, the court rejected his petition.
After this he filed an appeal in the division bench. During the hearing of the appeal, the issue arose that Moti Ram had been working continuously for 24 years and applications for regularization were also sought. The division bench of the High Court ordered to regularize his service.
The Marketing Board reached the Supreme Court challenging this order. After hearing the case, the Supreme Court, using its prerogative under Article 136, rejected the petition of the Board and upheld the order of regularizing the service of Moti Ram.
