The Supreme Court on Thursday said that being the highest court of the country, efforts should be made to minimize such mistakes which can have a far-reaching impact on the development and growth of the country or the environment. The court should also look at the implications and consequences for the country as a whole.
A bench of Chief Justice Surya Kant, Justice Joymalya Bagchi and Justice Vipul M. Pancholi cautioned that the message should not be sent that there is no element of predictability and certainty in the judicial system or that the courts are contradictory. The bench made these observations while hearing petitions related to granting retrospective environmental clearance to projects.
The apex court had on November 18 last year reversed its own decision, paving the way for the Central government and other authorities to grant retrospective environmental clearance to projects violating environmental norms by paying huge penalties. The court said that by not doing so, thousands of crores of rupees would be wasted.
The apex court had said with a majority of 2:1 that if the order of May 16, 2025 is not withdrawn, then many important public projects built by spending about Rs 20 thousand crore from government funds will have to be demolished.
During the hearing on Thursday, senior advocate Gopal Shankaranarayan, referring to the November verdict, said that the three-member bench had given some findings on the merits of the case. He said the May decision was that of a two-member bench. The bench said, 'There should not be a wrong impression in the mind of any stakeholder that the court does not consider all things while passing the order. A decision has been given on the review petition.
The bench heard the matter in detail and adopted a view. We should respect that point of view also. Some lawyers also mentioned the interim applications filed in this case. On this the court said that it will hear the matter including these applications on Monday.
