Transgender And Homosexual Couples Allowed To Live In 'live-in', Allahabad HC Orders Police To Provide Security

The Allahabad High Court, in a decision, has provided protection to a live-in relationship between a transgender person and another person, directing them not to interfere in their lives by their families or any other person. Describing the fundamental right to life and personal liberty of the Constitution as paramount, the court has also ordered the police to provide immediate security if needed.

The matter is related to Majhola police station area of ​​Moradabad district. Both the petitioners are adults and have voluntarily decided to live in a live-in relationship. The petitioners said that there was a threat to their life and property from the family itself. Demanded protection from the local police, but when no action was taken, they took refuge in the High Court.

Justice Vivek Kumar Singh said in this matter that any adult person has the full right to choose his life partner as per his own wish and family or society cannot interfere in it. The court cited the Supreme Court case Navtej Singh Johar vs. Union of India (2018), which had struck down Section 377 of the IPC, recognizing homosexual relationships.

The court said, such relations do not violate Articles 14, 19 and 21 of the Constitution. Referring to the case of Akanksha vs. State of UP (2025), the Court confirmed that the rights to life and liberty are protected even in the absence of marriage or inability to marry. The court said, 'Once an adult person chooses his life partner, the family or anyone else has no right to hinder his peaceful life. It is the duty of the state to protect the life and liberty of every citizen.

The court also directed that if there is any hindrance in the peaceful life of the petitioners, they should approach the Police Commissioner or SSP. Police will provide immediate security. If there is no documentary evidence, the police can verify the age by using ossification test or other legal procedure. If no crime is registered then the police will not take any coercive action.
