'We Were Provoking People In Pak-China Border Area', Center Justified Sonam Wangchuk's Detention In Supreme Court

The debate in the Sonam Wangchuk case will continue in the Supreme Court on Wednesday also.

Digital Desk, Jammu. The Center and Union Territory Ladakh administration told the Supreme Court on Tuesday that environmentalist Sonam Wangchuk was detained for inciting people in the border areas.

Upholding Wangchuk's detention, Solicitor General Tushar Mehta told the bench of Justices Arvind Kumar and PB Varale that all procedural safeguards were followed while ordering his detention under the National Security Act (NSA).

Fully followed all NSA rules

"This court is dealing with a person who is provoking people in the border areas with Pakistan and China, where regional sensitivities are of greater importance," Mehta told the bench.

He said that even while taking action, Wangchuk has been treated fairly. Mehta said that all the rules of NSA were completely followed.

The arguments remained inconclusive and this trend will continue on Wednesday also. Let us tell you that on Monday the Center had said that Wangchuk had tried to instigate Gen Z on the lines of protests like Nepal and Bangladesh.

Mehta said that Wangchuk, in his inflammatory speech, also mentioned movements like the Arab Spring, due to which governments fell in many countries of the Arab world.

NSA gives authority to stop anti-nationals

The top court was hearing a petition filed by Gitanjali J Angmo, wife of jailed environmentalist Sonam Wangchuk, against her detention under the stringent NSA. The NSA empowers the Center and states to detain people to prevent them from acting in a manner "prejudicial to the defense of India". The maximum period of detention is 12 months, although it can be canceled earlier.

On 29 January, Wangchuk, detained in Jodhpur Central Jail, denied allegations that he had made any statements calling for the overthrow of the government, akin to the 'Arab Spring', and insisted that he had the democratic right to criticize and protest. Senior lawyer Kapil Sibal said the police had resorted to "borrowed material" and selectively used videos to mislead the detaining authority.

Wangchuk's wife called the detention illegal

Angamo claims that the detention is illegal and an arbitrary action in violation of their fundamental rights. Wangchuk was detained on September 26 last year. This happened when there were violent protests demanding statehood and Sixth Schedule status to Ladakh. Four people were killed and 90 people were injured.

The government had accused Wangchuk of inciting violence. The petition said it is completely “absurd” that Wangchuk was suddenly targeted when he has been recognized at the state, national and international levels for his contribution to grassroots education, innovation and environmental protection in Ladakh and across India for more than three decades.

It is wrong to link Leh's violent incident to Wangchuk.

Angmo said the unfortunate incidents of violence that took place in Leh on September 24 last year cannot be linked in any way to Wangchuk's actions or statements. Angmo said Wangchuk himself condemned the violence through his social media handles and clearly stated that the violence would undo Ladakh's "penance" and five years of peaceful efforts, and that it was the saddest day of his life.
