On Interim Maintenance, Delhi High Court Said – Wife Cannot Be Considered The Earning Person; Husband's Income Should Be Calculated From Minimum Wage
Delhi High Court has given an important decision on interim maintenance. The court said that the wife's ability to earn or bear expenses cannot be automatically assumed, especially when the husband does not have any concrete evidence. In one case, the court considered the maintenance of Rs 2,500 fixed by the family court as inadequate and directed the husband's income to be assessed on the basis of minimum wages and increased the amount to Rs 3,500 per month.
