The Supreme Court has sought a reply from the Uttar Pradesh government regarding the rehabilitation of the people affected by the removal of illegal construction in Sanjay Nagar, Mathura. The apex court has asked the state government as to how much time it will take to settle the complaints and issues related to rehabilitation of the affected people.
Ordering to inform after taking instructions from the state government's lawyer, the court ordered to put the case on hearing again next week. These orders were issued by the bench of Justice Pankaj Mittal and SVN Bhatti after hearing the arguments of lawyer Dr. Rajeev Sharma on the contempt petition filed by the people who are being affected by the removal of illegal construction in Sanjay Nagar.
The court had given the order
Earlier, while mentioning the contempt petition, Rajeev Sharma told the court that people have received eviction notice and demolition action will be taken soon. But till now the state government has not taken any steps regarding the rehabilitation of the affected people. Whereas, on April 10, 2023, the Supreme Court had ordered the state government to soon bring a plan for the rehabilitation of the affected people.
The state government has not followed the order of the court and this is a violation of the court order. Sharma said that about 5000 people are living there and there are 700 houses. After hearing Sharma's arguments, when the court asked the counsel for the Uttar Pradesh government about the rehabilitation of the affected people, he sought time to take instructions.
Case of illegal construction of Sanjay Nagar of Mathura
The court asked the counsel for the state government to take instructions and tell the court how much time the state government will take to resolve the complaints and problems of the affected people for rehabilitation under the scheme in which those people have applied for rehabilitation. The court will hear the matter again next week. This case pertains to illegal construction of Sanjay Nagar in Mathura.
In this case, the High Court had ordered the removal of illegal construction, against which Sanjay Nagar Vikas Seva Samiti and the affected people had approached the Supreme Court and while rejecting the petition on April 10, 2023, the Supreme Court had refused to interfere in the High Court order, but in the same order had asked the state government to soon bring a rehabilitation plan for the affected people.
The petitioners say that three years have passed since the court order, but the state government has not yet taken any steps for their rehabilitation.
