'Earning Wife Has No Right To Maintenance From Husband', HC Cancels Family Court Order

The Allahabad High Court held that if the wife is capable and earning, she is not entitled to receive maintenance from her husband. The bench of Justice Renu Aggarwal quashed the order of the Family Court in which it was directed to pay maintenance to the wife. The High Court said that under Section 125 of the Code of Criminal Procedure, maintenance can be claimed only if the wife is unable to maintain herself.
